Incredible Events Terms and Conditions For Equipment Hire

PLEASE NOTE THAT FOR DRY HIRE THE FULL RESPONSIBILITY FOR EQUIPMENT USE, PROTECTION AND ALL INSURANCE COVER ARE THE FULL RESPONSIBILITY OF THE HIRER.

General:

The terms and conditions set out below shall be the basis of all Contracts of Hire Terms with Incredible Events which shall be concluded by a Rental Agreement form by any person, persons or body corporate and the delivery of goods by Incredible on the basis of such Rental Agreement.

Incredible Events shall not be liable to the customer for any direct or indirect or consequential losses, damages or inconveniences suffered or incurred by the customer due to any circumstances of the hire.

Definition:

In these terms and conditions Incredible Events means Incredible Events Limited whose principal place of business is Tommy Taylors Lane, Cheltenham, Gloucestershire, GL50 4NR. The Hirer / Hire Company shall mean any person, persons or body corporate entering into a rental agreement with Incredible Events Ltd for the hire of goods and equipment. “Goods and equipment” referred to in the emails related to equipment provided. “The terms and conditions” refer to those set out below and shall be the sole conditions of any contract with Incredible Events. Any addition or amendment can only be made in writing and ratified by a Director of Incredible Events.

The Period of Hire:

  1. The period of hire shall commence with the hirer taking possession of the equipment and shall terminate when equipment is returned.
  2. Where equipment is collected and returned by hirer, hirer’s servant or agents such delivery or collection is at the hirer’s risk and expense and the hirer shall be liable for physical loss and damage and delay to the equipment from the time the equipment leaves Incredible Events premises.
  3. The hirer will provide adequate and appropriate insurance to cover the full, new for old replacement cost of the equipment.
  4. The hirer must collect the equipment on the hire date and time agreed and return the equipment at the time agreed on corresponding email.
  5. The hirer if responsible for item / package return they must return all items in original condition by appropriately insured courier (value of items £3000 minimum)  within 24 hours of the end of the hire agreement unless agreed in writing in advance by Incredible Events. Any delay will be charged at: up to 48 Hours 50% of item value. 48 Hours  7 days - 100% of item value. Over 7 days 150% of item value.
  6. The date of the event is the date the hire is in place. All equipment must be returned on a 24 hour service within 48 hours of the end of the hire date.

Equipment:

  1. The hirer will satisfy himself on taking possession of all equipment that it is in good working order and in undamaged condition. This must be done within 4 hours of the collection, delivery / courier delivers. Any matters relating to the substandard condition or working of the equipment must be referred to Incredible Events. All Decisions on Replacement or Discount will be the responsibility of Incredible Events.
  2. All equipment on hire remains the absolute property of Incredible Events.
  3. The hirer shall have no authority to transfer or otherwise part with possession of the equipment during the period of hire unless the express written consent of Incredible Events is first obtained.
  4. All sizes, equipment and images used or quoted are guidelines only. Incredible events reserves the right to on rare occasion change items in packages without prior warning. if this is done then we will always try to ensure the hirer is given at least the same value of equipment as replacement.
  5. In the event that the hirer intends to take equipment out of the main land of England, Scotland or Wales or use the same for any abnormal or hazardous assignment then consent must first be obtained from Incredible Events who may at their sole discretion vary the terms of the rental.
  6. Incredible Events retain the right to change and amend packages or equipment without prior notice.

Damage or Loss to Equipment Hired:

  1. It shall be the absolute responsibility of the hirer to ensure the safe keeping of equipment and the hirer will indemnify Incredible Events in respect of any loss or damage howsoever caused whilst in the hirer’s possession.
  2. All damage or loss will be notified to Incredible Events immediately (or as soon as practicable) following which the goods must be returned to Incredible Events on the date and time previously agreed. The hirer may carry out repairs to the damaged equipment only with the express consent of Incredible and shall otherwise make no attempt to examine, diagnose, repair or remove any outer casing of the equipment hired.
  3. The hirer shall be liable to pay the full cost of repair and / or replacement of any equipment lost or damaged beyond repair with reference to new equipment of the same or nearest available specification as determined by Incredible Events Ltd. This cost may also include a charge for the time and inconvenience of having to replace any items.
  4. In the event of loss or damage to equipment the period of hire will without further reference to the hirer extend until such time as full reimbursement for the cost of replacement of the lost or damaged equipment has been made whether or not such period extends beyond that of the original rental agreement.
  5. In the event that the Hirer has a credit account and damage has occurred then a subsequent Invoice will be raised and will be due for payment within 7 days. If not paid within this period a 5% daily charge on the total balance will be accrued. If with a company with a Purchase Order System then a Purchase Order must be raised immediately and any higher approval or good received required must be completed as a matter of urgency and always within 7 days of the damage invoice being issued via email.

Liability:

  1. Incredible Events shall not be liable under any circumstances whatsoever for losses incurred by the hirer due to faulty or non-functioning equipment during the period of hire. All Equipment is fully tested before every hire to ensure that it is in fully working order. Incredible Events will, if they deem necessary take all steps necessary to ensure that faulty equipment is replaced with either the same or similar equipment.
  2. The hirer will indemnify Incredible Events at all times fully against any liabilities, demands, actions, claims or proceedings arising from or in connection with the equipment hired.
  3. In the event that the hirer shall create, use with or in conjunction to any equipment hired any unique or original material or matter Incredible Events shall have no liability whatsoever in respect of the loss, damage or imperfection of any such material and the hirer will fully indemnify Incredible Events in respect of any such claims by a third party.
  4. The operational requirements that are provided with equipment must be adhered to by the Hirer / hire company. This includes but is not limited to, ensuring that all equipment is used in areas and at a height that can not be touched by members of the public.
  5. Operational recommendations for hired equipment operation may be provided with some of our equipment and packages. These details are for use as a guideline and are in no way whatsoever a definitive operating procedure. All use of all hired equipment remains the whole responsibility of the Hirer / Hire Company.

Rental Fees:

  1. During the Rental agreement the hirer will pay the rental fee as specified in the Rental Agreement as set out in the email correspondence plus V.A.T. In the event of the Rental Agreement specifying a daily rate then such rate will be charged to the end of the day on which the equipment is returned.
  2. Incredible Events reserve the right to charge a cancellation fee not exceeding the full rental charge under the Rental Agreement.
  3. All fees under the Rental Agreement will be discharged at the time of the hirer returning the equipment or with the specific consent of Incredible Events up to thirty days after the date of any invoice subsequently issued.
  4. Incredible Events reserve the right to charge at the daily rate for any late returned equipment.
  5. Incredible Events reserve the right to determine the contract and recover any equipment hired in the event of bankruptcy, insolvency or liquidation of the hirer.
  6. Where the hirer is a body of corporate registered in the United Kingdom Incredible Events may in their sole discretion require a surety to the Rental Agreement. The surety hereby agrees to indemnify Incredible Events in respect of all sums due under the Contract of Hire in the event of partial or total default by the Hirer / Hirer company.

Delivery and Collection Service:

    1. Either delivered by Incredible events or a a courier will be provided with all Incredible Hire Packages, both to deliver and return the hired equipment. It is the responsibility of the Hirer to return all of the equipment, safely packaged at the date required. The Courier will require someone to be on the delivery and collection site all day. If a delivery is missed and the subsequent event does not go ahead on the planned date then there will be no refunds issued. The standard service is usually 3 working days from payment being received, however this can take on occasions up to 7 days. We can offer a faster service, please contact us before booking with these requirements and additional charges for this service will be added. ANY DELAYS TO SHIPPING REGARDLESS OF THE SERVICE IS THE RESPONISBILITY OF THE HIRER. THERE WILL BE NO COMPENSATION FOR ANY MISSED DEIVERYS OR EVENTS. PLEASE ALLOW ENOUGH TIME FOR YOUR EVENT TO AVOID DISSAPOINTMENT.

     

    1. The delivery address must be provided by the Hirer and all delivery and collections will occur at this address unless agreed in writing by Incredible Events.

     

    1. Any Delays caused by the courier being missed could result in an additional charge up to the original price of the package per day that the items are not returned.

     

    1. If the courier is missed the responsibility to arrange the return all of the equipment safely becomes the responsibility of the Hirer / Hirer company.

     

    1. Before booking conformation please ensure that the mobile number provided will be of someone 100% available to be at the collection point when necessary.
  1.   6. Incredible events reserves the right to collect the items when convenient to Incredible events. It is the venues responsibility to store and safely protect all items during any period post event. It is also the venues responsibility to provide access whenever required by Incredible Events.

 

SPARK STREAMS:

The use and liability of these machines is fully the responsibility of the hirer and the venue.

  • Please ensure that all people are at least 3m from the machines during operation.
  • The machines are provided to the venue as dry hire and fully at the venues responsibility for location, operation and safety.
  • The controller has 4 settings A – D. You will Only Need A and B – On (B) and Off (A)
  • The units have a total run time of approx. 6 mins.
  • We recommend the operator to use them in 5/10 second blasts only.
  • Please ensure there is no sensitive equipment / items in line with the machine output.
  • The units must not be run dry of the titanium pigment as it can break the machines. If this happens the cost of repair / replacement will be the responsibility of the venue.
  • Whoever has the controller to ensure that they do not exceed the run time, there is a hopper which can be checked by lifting (and always replacing afterwards) the small circular plastic lid on the top.
  • When the machines are heated (all four red lights are solid) please ensure the controller is in a safe location and the buttons can not be accidentally pressed. The warm up is approx 4 – 8 mins
  • We recommend turning the machines off between extended blasts.
  • At the end of the show please ensure the machines are switched off at the unit and power source.
  • If only one machine comes on with a button press just point the controller towards the unit not firing although this is a rare occurrence.

Payment:

  1. Payment for hire goods ordered shall be made before any courier is dispatched from Incredible Events, unless the customer shall have been granted a credit account. In the absence of any specific credit period the invoice shall be construed to express a maximum period of thirty days.
  2. There may be a 25% deposit paid in advance on all packages. This will be returned within 7 days of the equipment being retuned with no damage.
  3. Incredible Events reserve the right to add to any overdue balance at the due date an additional sum calculated by reference to 8% per annum above clearing bank base rate for the time being on any outstanding balance accruing on a daily basis.
  4. Where an order made by customers is accepted by Incredible Events and a deposit is paid over by the customer and such sum is agreed between the parties, Incredible Events reserve the right to retain the full amount of the deposit to set against any costs they incur in fulfilling the customer’s order. If any damage exceeds the deposit then the additional costs will be paid by the hirer in line with the terms above.

Deposits:

All deposits must be paid in full before any item dispatch. Incredible events will determine what level of deposit is required and if any or all of this deposit is to be retained to pay for damaged or unreteurned items. Incredible Events also reserves the right to invoice for the value of any items not returned as sent to the cost of twice replacement value.

All deposits will only be returned to the companies business bank account.

All items are the responsibility of the hirer as is safe, insured courier return of items.

LIABILITY: Incredible Events shall not be liable to the customer for any direct or indirect or consequential losses, damages or inconveniences suffered or incurred by the customer or the customers clients under this contract due to any circumstances.

 


 

Incredible Party Boxes – Terms and Conditions

 

  1. All Incredible Party Boxes (IPB) content descriptions are to be used as a guideline. Whilst we always endeavour to provide exactly what is described in each package, on occasion there may be some variations to the contents. If an item is out of stock we will replace the missing item with other items from the same pack to equal value. In which case there there will be no refunds for party boxes supplied.

 

  1. The hirer will indemnify Incredible Events at all times fully against any liabilities, demands, actions, claims or proceedings arising from or in connection with the equipment provided in the IPB.

 

  1. A courier will be provided with all Incredible Hire Packages, both to deliver and return the hired equipment. It is the responsibility of the Hirer to return all of the equipment, safely packaged at the date required. The Courier will require someone to be on the delivery and collection site all day.

 

  1. The delivery address must be provided by the Hirer and all delivery and collections will occur at this address unless agreed in writing by Incredible Events.

 

  1. Any Delays caused by the courier being missed could result in an additional charge up to the original price of the package per day that the items are not returned.

 

  1. If the courier is missed the responsibility to arrange the return all of the equipment safely becomes the responsibility of the Hirer / Hirer company.

 

  1. Any issues caused by the courier service itself will, IE will not be liable in any way for delays, loss or damage. In most cases the items will be insured however so refunds for lost or damaged items could be paid.

 

  1. Before booking conformation please ensure that the mobile number provided will be of someone available to be at the collection point when necessary.

 

  1. All customers should ensure they book their IPB in plenty of time before the event.

 

  1. IE do not offer refunds or returns of IPB.
